Terms of Service

These terms are an agreement between you and Coder B Dev, Inc., a Wyoming corporation ("PodScene", "we", "us"), and cover your use of PodScene: the website at podscene.app, the app at studio.podscene.app, and everything they provide (the "Service"). By creating an account or using the Service you agree to these terms. If you use PodScene for an organization, you agree on its behalf and confirm you're allowed to.
1. Who can use PodScene
You must be at least 16 years old to create an account or to join a recording as a guest. You're responsible for keeping your login details safe and for everything done with your account. Tell us at support@podscene.app if you think someone else has access to it.
2. Accounts, organizations and guests
Each account belongs to an organization, which holds the plan, the shows and the recordings. The organization's admins decide who else can access it. Guests join a recording from a link and don't need an account. The person who invites a guest is responsible for that guest's use of the Service during the recording.
3. Recording other people
PodScene records the video and audio of everyone in a session. Before you record anyone, you must tell them they are being recorded and get any consent the law requires where you and they are. You're responsible for how you use, publish and share your recordings.
4. Your content
You keep all rights to what you upload and record: video, audio, images, names and text ("Your Content"). You give us permission to store, process, render and transmit Your Content only as needed to provide the Service to you, for example to composite your recording, deliver it to your guests and OBS during a session, and let you download it. We don't use Your Content for advertising or to train AI models, and we don't claim ownership of it.
You confirm that you have the rights to everything you upload, including backgrounds, intros, outros and images.
5. Acceptable use
You agree not to use PodScene to:
- break the law, or record people without the notice or consent the law requires;
- upload or record content that infringes someone else's rights, sexually exploits minors, or harasses, threatens or incites violence against anyone;
- distribute malware, or try to access accounts, recordings or systems that aren't yours;
- overload, disrupt or reverse-engineer the Service, or get around plan limits or the watermark;
- resell the Service without our written permission.
We may remove content or suspend accounts that break these rules.
6. Plans, payment and cancellation
The Free plan costs nothing. Paid plans are billed in advance, monthly or annually, in US dollars, through our payment processor, and renew automatically until you cancel. Prices and limits are listed on our pricing page. Taxes may be added where required.
You can cancel at any time. Your plan stays active until the end of the period you've paid for, then your organization moves to the Free plan. We don't refund partial periods, except where the law requires it. If a payment fails, we'll retry it. If it still fails after a grace period, your organization moves to the Free plan.
On the Free plan, or after moving to it, the Free plan's limits apply. Shows over the limit become read-only rather than being deleted, and recordings older than the Free plan's retention period are deleted on the normal schedule.
We may change prices or plan limits. We'll tell you at least 30 days before a price change affects you, and it applies from your next billing period.
7. Retention and backups
Recordings are kept for your plan's retention period, then deleted automatically. PodScene is a recording service, not an archive: download anything you want to keep. We take care to keep your data safe, but we're not liable for recordings lost after they expire, or for any loss you could have avoided by downloading.
8. Availability and changes
We work to keep PodScene running, but we don't guarantee it will always be available or free of errors. Recordings depend on each participant's device, browser and connection. We may change, add or remove features. If we make a change that significantly reduces a paid plan, we'll tell you in advance.
9. Ending your use
You can stop using PodScene and ask us to delete your account at any time. We may suspend or end your access if you break these terms, if your account has unpaid charges, or if the law requires it. Where we reasonably can, we'll warn you first and give you a chance to download your recordings.
10. Copyright complaints
If you believe content on PodScene infringes your copyright, email support@podscene.app with: your contact details, the work you believe is infringed, where the content appears, a statement that you believe in good faith the use isn't authorized, and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for them. We'll respond and remove infringing content where appropriate.
11. Disclaimers
The Service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
12. Limitation of liability
To the extent the law allows, PodScene won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim related to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and US $50. Nothing in these terms limits liability that the law doesn't allow to be limited.
13. Indemnity
You agree to defend and compensate PodScene for claims, losses and costs arising from Your Content, your recordings, or your breach of these terms or the law.
14. Governing law
These terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Wyoming, and both of us consent to their jurisdiction. If you're a consumer, this doesn't take away any protection you have under the mandatory laws of the country you live in.
15. Changes to these terms
We may update these terms. If a change is significant, we'll tell you by email or in the app at least 30 days before it takes effect. If you keep using PodScene after that, you accept the new terms.
16. General
These terms and our Privacy Policy are the whole agreement between us about the Service. If any part is found unenforceable, the rest still applies. If we don't enforce a term right away, we haven't waived it. You can't transfer these terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets.
